Independent Designer Raises Concerns Over Lack of Transparency in DMCA Takedown Process

Independent designer Sam Archer of SamuelArcherDesigns is speaking out about the lack of transparency and clarity in the digital content takedown process after one of his original designs was removed from the online platform TeePublic following a complaint from Ceremony of Roses, a merchandising company affiliated with Sony Music Entertainment.
The design, titled “A Tribe Called Blessed!”, was removed after TeePublic received what it described as a “valid takedown notice.” However, according to Archer, neither the platform nor the claimant provided specific details explaining what aspect of the design allegedly infringed on intellectual property rights.
“I respect intellectual property laws and the need to protect artists and brands,” Archer said. “But when content is removed without a clear explanation of what rule was violated, it creates uncertainty for independent creators trying to operate in good faith.”
Under current DMCA (Digital Millennium Copyright Act) procedures, platforms like TeePublic are required to remove content upon receiving a valid complaint in order to maintain legal protections. However, these processes do not require detailed explanations to be shared with creators at the time of removal.
Archer notes that while the system is designed to protect rights holders, it can leave independent designers at a disadvantage.
“The burden shifts entirely onto the creator to challenge the claim, often requiring the submission of personal information and legal statements, without first being given a meaningful explanation of the alleged infringement,” he said.
The incident highlights a broader concern within the creative community regarding the balance between intellectual property enforcement and fair treatment of independent artists. What if the alert came from an A.I. detector that was inaccurate? It now means the designer is inconvenienced for no reason.
Archer is calling for platforms and rights holders to adopt more transparent practices, including:
Providing specific explanations of alleged infringements
Identifying the exact intellectual property at issue
Offering clearer guidance to help creators avoid future conflicts
“As digital marketplaces continue to grow, there is an opportunity to improve these systems so they support both rights holders and independent creators,” Archer added.
